We have created this contest because we think it is fun to walk into your favourite baby store and see your child’s picture on a product! Please do not be fearful of the below legal document, it is just to protect all parties involved.  Good luck!

CONTEST RULES

• Image must include a Simply on Board toy strap. Min resolution 1MB.
  • Tip: Clear and product oriented pictures will give you a better chance of winning. Think about the types of pictures you see on all types of packaging!
• There is no limit to the number of submissions.
• The final decision will be made by Simply on Board, however we are definitely influenced by support for your image.  Get your friends to post their comments and support!
• All entries must be submitted by Dec 31, 2011, 11:59 p.m. EST.

STEP #1

CONTEST WAIVER

I hereby irrevocably grant to Simply on Board, of the Pippalily Ltd. Group of companies, (“Simply On Board”) its successors and assign the absolute and unrestricted right in perpetuity and permission to reproduce, publish, display, distribute and/or otherwise use and reuse the likeness, photographs and image of  (the “child”) in print, electronic and all forms of digital advertisements, point of sale materials (including signage and displays), collateral, billboards, pamphlets, brochures, posters, out-of-home (OOH) usage and packaging, alone or accompanied by other material, throughout the world for the purpose of advertising, marketing and promoting Simply on Board products.

I hereby waive any rights to inspect and approve the finished materials or their use.  Nothing herein will constitute any obligation on Simply On Board’s part to make any use of any of the rights set forth herein.  I agree that all right, title and interest in and to the finished product, including the copyrights therein, shall vest exclusively in Simply On Board.  I hereby release and discharge Simply On Board from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may exist in any media or in any publications thereof.

I represent and warrant that I am the parent and/or legal guardian of the child and have the full right and power to execute this Release on behalf of the child and I agree further that I will not hold Simply On Board or anyone who receives permission from Simply On Board responsible for any claim or liability resulting from the use of likeness, photographs or image of the child in accordance with the terms hereof, including, but not limited to, claims in the nature of copyright infringement, defamation, disparagement, slander, false light, invasion of privacy or publicity or the like. No compensation is due or payable for the rights granted above.

This Release contains the entire understanding between the parties regarding the subject matter hereof and supersedes all prior understandings. No waiver, modification or additions to this agreement shall be valid unless in writing and signed by both parties hereto.

I am over 18 years of age and have the right to make this agreement.
